What is WP GDPR Fix?

What is EU GDPR?

The GDPR aims primarily to give control to citizens and residents over their personal data and to simplify the regulatory environment for international business by unifying the regulation within the EU.

Basically, if you’re based in the EU or you “offer goods or services to, or monitor the behavior of, EU data subjects,” the GDPR will force you to be more transparent regarding the kinds of personal data you collect and what you do with it. Furthermore, prospects must give their expressed consent for you to harvest and utilize that data.

This Regulation goes into effect across the entirety of the EU by May 25, 2018.

So what are these 7 GDPR Fixes?

  1. Cookie Consent. Automatically inform your visitors (via popup) about cookie use and gets their consent.
  2. T&C Acceptance. Generate a T&C Acceptance check box/button and (optional) force acceptance by users.
  3. Privacy Policy. Generate a Privacy Policy check box/button and (optional) force acceptance by users.
  4. Right To Be Forgotten. Collect right to be forgotten requests and automatically notify website owner/administrator.
  5. Data Access. Collect Data access requests and automatically inform administrator.
  6. Data Breach Notification. Sends data breach notification to all users (within 72 hours) as required by law.
  7. Data Rectification. Collect data rectification request and update owners and administrator.

All above choices are optional. So you can choose whether features you want to use/install on your blog.

WP GDPR Fix vs GDPR Pro

The creators of GDPR Pro who come with their launch 9 days later than WP GDPR Fix do everything to convince you that it’s a better WordPress plugin and that you can or should use them together…

Their reasoning is that WP GDPR Fix doesn’t register Cookie consent or Privacy Policy and/or Terms of Services agreement in case you need to prove that your visitors have given their approval.

And their solution is to show a popup box to every new visitor (or visitors from certain countries, think about all EU countries for GDPR purposes) where the visitors have to fill in their name and email address, to check a box to agree with the usage of personal data, to agree with getting emails, and to agree with the Privacy Policy and/or Terms of Services.

And as all these details are logged, you as website owner have all the prove and be fully GDPR compliant.

But this solution comes with a “high price”, you’ll ask your new visitors to give their details without even having seen your page yet!

I don’t like that solution and it’s a conversion killer but maybe you can use GDPR Pro just for specific page(s)?

For me, there are 2 situations…

If you are using cookies and placing pixels, you can use any plugin that allows you to create a “Cookie Consent” box to inform your new visitors that you are using cookies. This is required by GDPR for EU website visitors.

And as good practice, refer to your Privacy Policy or Cookie Notify to show people what kind of cookies you are using.

But what happens if someone doesn’t agree that you are using cookies on you site?

Well, nothing…

As the browser places your cookie the moment someone visits your web page. There is no technical solution for website owners to only install a cookie after formal approval.

The only thing a visitor can do is to change the cookie settings in their browser and/or to clear their browser cookies.

What about Retargeting and Conversion Pixels?

It’s the same as with cookies, the pixel “fires” the moment a page is loaded.

Again the website visitor has no control.

The only thing a website visitor can do is change their Ad Privacy Settings (link goes to page where you can do that in Facebook).

So, from the side of a website visitor, this can be rather annoying or frustrating as most of the commercial websites are using cookies and pixels. But at least you have some control via your browser settings and privacy settings on social platforms.

For website owners, in general a cookie consent box is sufficient.

What about email subscriptions?

I’m not going into much detail but under GDPR you’ll need consent that you are allowed to send emails. For some emails related to purchase transactions there is a legitimate reason, but for promo and marketing emails you need formal approval. And in case you build your list by giving away a freebie, you have to inform what kind of other info you are sending inside your emails, or get explicit approval to send those kind of emails.

There is a lot of discussion how your email subscription should look like and whether you need a checkbox or not, but it depends on the words you are using (be as clear as possible and inform your new subscribers what they can expect to avoid complaints and unsubscribes).

But most important…

All major Email Service Providers do register data about new subscriptions and about opt-outs (as date, time, IP address, GEO location).

And although under GDPR you now have to fully delete all the data if an email subscriber requests you to do, you probably don’t need a plugin as GDPR Pro to comply with GDPR.

For me the only reason to buy GDPR Pro is to get access to the 3 interviews with the “GDPR expert” lawyers, or…

in case you want to lock access to your website (or single web page) and only show the content to people from whom you got the formal approval (and registration). Think about agreement to Privacy Policy, Terms of Services, Cookie Notification, Personal Data Usage, etc.

Are there any shortcomings?

Well, all the features just work as described or shown in the demo video.

That said, to comply to GDPR it’s not sufficient to just install this plugin!

GDPR involves many more regulations. For example, you need to clearly tell/explain which data you collect, for what reason, how long you’ll save the data, and what procedures you take to secure your data and whether you store data outside the EU.

So, you’ll probably have to analyze (and record) your data collection and procedures, as well as to update your Privacy Policy, Terms of Services, and Cookie Statement.

Furthermore, it all depends on what kind of data you collect and what kind of external software and apps you are using. You have your own responsibility and can’t hide behind external suppliers.

Especially because if you have breached or violated any part of the legislative package after initial sanctions, companies can be fined up to €20 million (approximately $23.5 million USD) or 4% of a company’s worldwide turnover, whichever is greater.

That’s why I advise you to do your “homework” and take this new regulation serious.
